1. Acceptance of Terms
By accessing or using the Creatorscon platform (“creatorscon.pk”, “Creatorscon”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users: creators, brands, agencies, and visitors.
2. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Each person or entity may hold one account per role (creator, brand, or agency). Sharing account access with unauthorised parties is not permitted.
3. Creator Obligations
Creators must provide truthful information about their audience, engagement rates, and social media handles. Fabricating or inflating follower counts, engagement metrics, or campaign results is a violation of these terms and may result in account suspension or termination.
Creators agree to deliver content as described in accepted bookings within the agreed timeline. Content must comply with the brand’s brief and all applicable Pakistani advertising regulations.
4. Brand and Agency Obligations
Brands and agencies must provide complete and accurate brief descriptions. Payment must be deposited into escrow before a booking is confirmed. Brands must review delivered content within the agreed review period.
5. Payments and Escrow
All payments between brands and creators are processed through Creatorscon’s escrow system. A platform fee of 10% is charged on each booking, added to the creator’s quoted rate and paid by the brand.
Funds are held in escrow until the brand approves the delivered content. Once approved, funds are released to the creator’s Creatorscon wallet. Creators may withdraw funds to their registered bank account, subject to a minimum withdrawal of PKR 1,000.
In case of disputes, Creatorscon will mediate between the parties. If no resolution is reached, Creatorscon reserves the right to make a final determination on fund distribution.
6. AI Agent and Automated Responses
Creatorscon provides an AI agent that responds to brand inquiries on behalf of creators. All AI-generated responses are clearly labelled as “AI drafted.” The AI agent acts as an assistant and does not constitute a binding commitment on behalf of the creator. Final booking decisions require explicit creator approval.
7. Intellectual Property
Creators retain ownership of their content. By accepting a booking, creators grant the brand a licence to use the delivered content as specified in the brief. Usage rights are limited to the scope agreed in the booking — additional usage requires separate agreement.
8. Prohibited Conduct
Users may not: circumvent the escrow system through off-platform payments; use the platform to distribute illegal, harmful, or misleading content; scrape or harvest data from the platform; impersonate other users; or interfere with the platform’s operation.
9. Account Deactivation and Termination
You may deactivate your account at any time. Deactivated accounts enter a 30-day grace period during which you can reactivate. After 30 days, the account and all associated data are permanently deleted.
Creatorscon reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or are subject to legal requirements.
10. Limitation of Liability
Creatorscon provides the platform “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed the platform fees paid in the preceding 12 months.
11. Governing Law
These terms are governed by the laws of Pakistan. Any disputes shall be resolved through arbitration in Karachi, Pakistan, in accordance with the Arbitration Act 1940, before resorting to litigation.
12. Changes to Terms
We may update these terms from time to time. Material changes will be notified via email to registered users at least 14 days before they take effect. Continued use of the platform after changes constitutes acceptance.
